Terms of Supply
This page tells you the terms on which we supply any of the products listed on this website (our site) to you. Please read these terms of supply carefully before ordering any products. You should understand that by ordering any of our products, you agree to be bound by these terms. Please understand that if you refuse to accept these terms, you will not be able to order any products from us.

We have the right to revise and amend these terms of supply from time to time. You will be subject to the policies and terms supply in force at the time that you order products from us.

Subscription Terms
All memberships are created on a subscription basis. Annual Memberships last for one year and a recurring payment instruction is initiated every 365 days. Quarterly Memberships are billed every 90 days and Monthly Memberships are billed every 30 days. You are only tied into your subscription for the period you select (365, 90 or 30 days) and can cancel at any time.

All our membership options operate a recurring payment instruction system, meaning we automatically bill you for each subscription period, according to your subscription type. If you wish to discontinue your membership, you must cancel the recurring payment instruction with your payment provider.

Access to the products will only pass to you when we receive full payment of all sums due in respect of the products.

Subscriptions are non-transferable.

We may close Facebook groups and refuse membership to Facebook groups at our discretion and without notice. Facebook groups are free bonuses and do not constitute a paid element of your subscription.

Refunds will not be applicable where exceptional circumstances are beyond the control of Mixed Up (such as a Force Majeure Event including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen).

Workshop Terms
Workshop fees are payable in full, in advance of the workshop date. Access to the products will only pass to you when we receive full payment of all sums due in respect of the products.

Because immediate access is granted upon payment, workshop bookings are non-transferable and non-refundable, except in the unlikely event that the workshop is cancelled by us.

Refunds will not be applicable where exceptional circumstances are beyond the control of Mixed Up (such as a Force Majeure Event including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen).

Consumer rights and cancellation
Memberships and online Workshops: Digital products do not fall within the ‘cooling off’ 7 day period required under UK Law. If you change your mind after purchase, you are not entitled to a refund. However, we will look at all cases on an individual basis – please email katy@mixedupmag.com to discuss your case. If we offer a refund after considering your individual case, an administrative fee will be charged.

Product kits: Kits are physical goods and therefore are covered in law by a 7 day ‘cooling off’ period. Kits are supplied by our partners Artful Days. You have a right to cancel an order seven working days from the day after you receive your goods. You then have a further seven days to return the item back to Artful Days.

To request a refund please email sales@artfuldays.co.uk. You will be issued a returns number and this number must be included in your returned parcel. Once we receive the whole order back we will issue a full refund including the original delivery charge within 14 days of us receiving the item, provided the item is received in the stated condition (see below). Please note that you will have to bear the direct cost of returning the product unless the goods are faulty.

Please be aware that the returned item(s) must be: in the same original undamaged packaging; unopened and unused; clean and fit to be resold; repacked or packed in suitable packaging fit for secure postage. Failure to do this may affect the value of the product and the refund.

Damaged or faulty goods:You have up to 30 days to report a faulty or damaged product (please note this does not apply to the packaging if the contents inside are intact and usable). We will arrange a full refund or replacement where possible. After this time we cannot accept responsibility for damage reported. We may ask you to take a photograph of the damaged item and the packaging it arrived in. We will cover the cost of return postage up to the value of what was originally paid.

Event prices, product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation. It is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our Order Confirmation procedures. If the correct price  is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions or reject your order and notify you of such rejection. We are under no obligation to provide any Product or Event to you at the incorrect (lower) price, even after we have sent you an Order Confirmation, if the pricing error is obvious and could have reasonably been recognised by you as an error.

Contracts and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any such dispute or claim will be subject to the nonexclusive jurisdiction of the courts of England and Wales.

Etiquette
Our tutorials and workshops have comments enabled so you can ask questions of our tutors or leave them feedback. We operate a zero tolerance policy on abusive or discriminatory comments or ‘trolling’ and anyone making such comments will be removed immediately without discussion. No refunds will be offered where members are removed for abusive behaviour.

Intellectual Property
All intellectual property rights (including but not limited to copyright) in all materials at all times belong to and shall remain vested in us and neither you nor any other person shall obtain any intellectual property rights or any other interest, right or title whatsoever in or to any materials or any part thereof save as otherwise expressly granted.

The instruction provided is for your own personal, educational, noncommercial purposes. You shall ensure that materials are only accessed by you and you must not make available, copy, reproduce, disseminate, retransmit, sub-license, distribute, sell, publish, broadcast or otherwise supply in any medium and in any manner any such materials (or any part of them) to any third party.

Privacy Policy
We want to protect the privacy of visitors to our website and that of our clients, and other individuals. Please read the following policy; it will help you to understand how we use your personal data. We may change our privacy policy at any time without giving you notice, so please check it each time you visit this website.

When you purchase a membership or workshop with us, we collect and store your personal information for the purposes of managing your experience. This information is stored on a secure website. These details are used only by Mixed Up and our newsletter client (Mailchimp) in order to communicate with you. Details will never be passed or sold to other third parties by either Mixed Up or Mailchimp.

If you buy a kit, these are provided by a third party partner and we will pass your address and email details to them in order to get your product shipped to you. They will retain your details for the purposes of communication with you about your purchase(s). Our partners have an agreement with us that they will never pass on or sell your details on to any other parties.

Your email address will be used to communicate with you about the product(s) you purchase. Members will be added to our Membership Newsletter which is sent weekly. Other customers will be added to our Mixed Up newsletter mailing list so we can inform you about future events, but you can opt out of this at any time by clicking the link provided in every email. We may also contact you directly if there are any issues with your account.

We do not collect or store any financial information from you – this is held by our secure and well-respected payment option providers Paypal and Stripe.

We may disclose personal information if required to do so by law, Court Order, or for the purposes of prevention of fraud or other crime or if we believe that such action is necessary to protect and defend the rights, property or personal safety Mixed Up, our website or its visitors.

We cannot guarantee the privacy of personal information you transmit over the web or that may be collectable in transit by others, including contractors who provide services to us.

Cookies
A cookie is a text-only string of information that a website transfers to the cookie file of the browser on a computer so that the website can remember who you are. This site uses cookies to help the site provide a better user experience. In general, cookies are used to retain user preferences, store information, and provide anonymised tracking data to third party applications like Google Analytics.

Two types of cookies may be used on this website, session cookies, which are temporary cookies that remain in the cookie file of your browser until you leave the site, and persistent cookies, which remain in the cookie file of your browser for much longer (though how long will depend on the lifetime of the specific cookie).
